Stupak: Health bill abortion fight can be resolved

TAWAS CITY, Mich. (AP) - Michigan Democrat Bart Stupak says prospects are good for resolving a dispute over abortion that's led some House Democrats to threaten to withhold support of President Barack Obama's health care overhaul.

Stupak said Monday he expects to resume talks with House leaders this week about wording that wouldn't impose new limits on abortion rights but also wouldn't allow federal funding of the procedure.

Stupak's emerged as spokesman for about a dozen House Democrats who say the Senate's version of health legislation would authorize federal abortion subsidies. They insist on restoring stiffer restrictions from the House measure.

Stupak tells The Associated Press he's more optimistic than last week. He'd said then that nothing had changed and he didn't think House leaders had the votes to pass the bill.

If the House passes a Senate bill exactly, the bill goes to the President, not back to the Senate.

I think the plan is for the House to amend the Senate bill, pass it, and send it back to the Senate. The Senate will use reconciliation to consider the House amendments, and then send the corrected bill back to the House for final approval.

Unless Stupak and the gang get sandbagged. Once the House passes Commiecare™, Hussein can then sign it.

Tricare fee increases imposed last week by the Defense Department will be repealed by a provision of the compromise 2010 defense authorization bill unveiled Wednesday by House and Senate negotiators.

The fee increases were announced on Sept. 30 and took effect on Oct. 1, but the defense bill, HR 2647, includes a provision barring any fee increases until the start of fiscal 2011.

Retired Army Maj. Gen. Bill Matz, president of the National Association for Uniformed Services, said the announcement of fee increases was shocking considering that the Obama administration promised earlier this year to hold off on any new fee Tricare fee increases until fiscal 2011.

“President Obama and DoD assured NAUS and the entire military family earlier this year that there would rightly be no increases in any Tricare fees” in fiscal 2010, Matz said. “We took them at their word, and I can’t believe that a co-pay increase like this was allowed to go forward,” he added.

If they do, it goes back to the House, and Stupak and his votes will still control the day.

The question is, how does the Senate remove the abortion language? Is it done by the Democrat/pro-abort majority? If so, Stupak will need to kill the bill when it is returned to the House.

But if the GOP removes the abortion language in the Senate in order to "force" Stupak to vote against ObamaCare in general, then Stupak will have sufficient cover to change his vote.

Keep in mind folks any federal version of health care is unconstitutional since Article 1 Section 8 does not specifically grant Congress the power to regulate health care. The people are not bound to comply with any unconstitutional act of Congress.

The people are the government, not Congress or BO?BS> The people have the final say in all matters.

The House cannot amend the Senate bill. It has to pass the House “as is” amd then go to Obozo to be signed. Then the reconciliation process can happen. The only way the bill can be changed is with reconciliation. I don’t believe the abortion language can be changed with that process.

Whether or not abortion language can be changed through reconciliation is a matter of the interpretation of Senate parliamentary rules, which are pretty fungible anyway. My thought is, once you put a national health care program through reconciliation, it’s hypocritical to exclude ethical funding restrictions as non-germane.

Obviously, though, it’s an important question that needs to be weighed carefully.

Correct! That is 100% correct, at which point the Senate passes reconciliation legislation to ‘reconcile’ the budgetary provisions in the bill. That is the whole reason the House Dems are terrified the Senate will just let the POTUS sign the bill and not reconcile it with the ‘fixes’ the HOuse is demanding. Once the House passes it, they have no leverage over the Senate to change anything. The POTUS may also be double crossing the House, he just wants SOMETHING passed. Right, I'm suggesting that they may try a new strategy, where the House amends the Senate bill before passing it, meaning that the bill goes back to the Senate, not to the President. I think such a strategy would be consistent with Stupak's prior statements.

but the Senate then needs 60 votes, not 51. Unless the hOuse passes the Senate bill, reconciliation does not apply.

Your point wasn't hard to understand and you can take your condescension elsewhere... or elaborate on your point like a normal person would do. Your original point was that you believe by saying the Senate would send the corrected version back to the House Reid, Pelosi and Obama will keep their word on 'reconciliation' and if you believe that, you are DEFINITELY in the minority.
