Wife killed Ga. soldier for insurance, feds say By Jan Skutch Morris News Service March 5, 2014
SAVANNAH, Ga. -- The wife of a slain Fort Stewart soldier schemed with her brother to kill her husband in exchange for a $160,000 insurance policy payout, a federal prosecutor said Tuesday.
Lillie Eubank, 39, told investigators she arranged to have her brother, Carl Evan “Cowboy” Swain, travel from Alabama to Savannah, bought a T-ball bat and selected the site for the attack at a recreation park on Fort Stewart, Assistant U.S. Attorney Cameron Heaps Ippolito said.
The victim, Army Spc. John Joseph Beans Eubank, 29, was found badly injured Nov. 30 by another solider. He was taken to Winn Army Community Hospital, where he died from blunt force trauma.
Lillie Eubank is charged with murder in the case. If convicted, she faces life in prison or the death penalty. Ippolito told U.S. Magistrate Judge G.R. Smith Tuesday she expects to present the case against Lillie Eubank to a federal grand jury Wednesday.
“This is a clear case for pre-trial detention,” Smith ruled in ordering the defendant to remain in custody.
He said the defendant is destitute, a flight risk and a danger to the community if released.
Smith denied a defense request for a preliminary hearing but said that if prosecutors fail to obtain an indictment this week, he will schedule a preliminary hearing in the case next week.
Swain, 43, was indicted Jan. 9 on a murder charge with special findings and remains in custody.
Prosecutors are expected to seek permission from the Justice Department to seek the death penalty in that case.
According to Ippolito, the defendant planned to pay her brother $30,000 in cash from her husband’s $500,000 life insurance policy over several mailings to his home in Alabama.

“They had my full name, the last four digits of my social security number, even the name of my bank, but they couldn’t tell me when I supposedly borrowed this money,” Lillie Eubank tells me.
She’s in a wheelchair and says her husband who is in the service will soon return to Iraq. “I don’t want her to be hassled by this after I leave,” Mr. Eubank tells me.

Damn! John Joseph Bean Eubanks obviously had some sort of problem - something if he married that. May he rest in peace, I hope he’s in heaven, because he’s done his time in hell. Just damn!

The deceased man found Nov. 30 at Holbrook Pond has been identified as Spc. John Joseph Beans Eubank, 29, a 3rd Infantry Division soldier assigned to Fort Stewart. Eubank, from Mt. Village, Alaska, was a motor transport operator in the 396th Transportation Company, 87th Combat Sustainment Support Battalion, 3rd Sustainment Brigade. He had deployed to Iraq three times and to Afghanistan once, returning from Afghanistan in May. He joined the Army in November 2003 and arrived at Stewart-Hunter in August 2004. Chaplain and casualty-assistance support have been extended to Eubank’s family.
According to CID officials, the death investigation is ongoing, so no additional information will be released at this time. 
The investigation into the death of Spc. John Joseph Beans Eubank, whose body was found Nov. 30 at Holbrook Pond, is continuing.

That’s a damned shame. If anything, I guess he was too trusting and loyal. I would have expected very bad eyesight or something. To be murdered by a slug like her after 3X Iraq and 1X Afghanistan isn’t something he deserved. She and her brother deserve the death penalty.
