MANHATTAN (CN) - As dusk settled over the city Monday, a federal judge ruled that New York City won its showdown with handgun owners who challenged a $340 residential licensing fee as unconstitutional. A city attorney applauded the ruling, saying the fees were needed to do the exhaustive background checks that keep New York City safe. "The city has some of the strongest laws in the nation to ensure that guns do not fall into the hands of criminals," Michael A. Cardozo said. "Today's decision rejects a constitutional challenge to home handgun application and renewal fees, upholds our ability to...

If you have trouble falling asleep, here's something new to try. When you curl up in bed tonight, bring along a copy of the local municipal code to read. Slogging through the lawyerly fine print will not only make your eyelids heavy, it could help you unearth some surprising discoveries. I learned the other day that if you earn an income working at home -- anything from lacing lanyards for a craft sale to consulting on paramilitary projects for Halliburton -- most East Bay cities require you to have a home occupation permit and a business license. There are a...

The U. S. Constitution's Precious Cargo* "Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can save it; no constitution, no law, no court even can do much to help it." - Judge Learned Hand The Constitution's words are only the vehicles which carry great ideas across the centuries. The precious cargo must be defined, protected, and treasured by "We, the People" in order for its benefits to accrue to each generation. Take the word, "liberty". What message does this semantic vehicle bring? Abe Lincoln: "We all declare for...

One thing I find fascinating as governor is the disconnect between those in and around the capitol and real New Mexicans. The issue of giving driver's licenses to illegal immigrants is perhaps the best example. They say it's controversial, but New Mexicans are remarkably united - across ethnic, party, and religious lines. Critics can attack my heritage, accuse me of being a "bad Catholic" for my position, but I will keep my word to you and continue the fight to repeal this dangerous law.

Although Minnesota's law states that students only have to stay in school until they are 16, lawmakers there are considering a bill that would not allow school dropouts to get their license, the StarTribune reported on Tuesday. "Driving is not a right, it's a privilege, and it's perfectly within bounds for the state government to...

I often see DUI cases or the like where the driver borrowed someone's car so they could drive despite the fact the have no license and/or are suspended. Why is it the owner of the car is never charged as an accessory to a crime? If the owner did not file a police report of their car being stolen and the driver has keys, the presumption of guilt and burden of proof should be on the owner of the car. (How else would another person be driving the car?)

Arizona Eyes Special License Plate for Tea PartyUpdated: Thursday, 03 Mar 2011, 4:37 PM MST PHOENIX - A bill advancing in the Arizona Legislature would give Tea Party supporters their own license plate but without taxpayers-provided startup costs that supporters wanted. But some of the proceeds of eventual sales of the "Don't Tread On Me" special plate would still go into a fund that a state committee would use to promote Tea Party principles. The Republican-led Senate gave the bill preliminary approval Thursday after deleting a provision to have the state highway fund front $32,000 of startup costs after critics...
