Fate of Fani Willis Has Been Decided (23 page ruling)
townhall.com ^ | 3/15/2024 | Mia Cathell

Judgement Day has finally arrived for Fani Willis.

Judge Scott McAfee, who presided over the Fulton County district attorney's disqualification proceedings, has ruled that Willis must step away from the Trump prosecution or cut ties with special prosecutor Nathan Wade, the private-practice attorney she hired to prosecute former President Donald Trump and with whom she had an undisclosed affair.

Advertisement According to the 23-page ruling, McAfee ordered, "[W]ere the case allowed to proceed unchanged, the prima facie concerns raised by the Defendants would persist. As the District Attorney testified, her relationship with Wade has only 'cemented' after these motions and 'is stronger than ever.' Wade’s patently unpersuasive explanation for the inaccurate interrogatories he submitted in his pending divorce indicates a willingness on his part to wrongly conceal his relationship with the District Attorney."

"As the case moves forward, reasonable members of the public could easily be left to wonder whether the financial exchanges have continued resulting in some form of benefit to the District Attorney, or even whether the romantic relationship has resumed."

"Put differently, an outsider could reasonably think that the District Attorney is not exercising her independent professional judgment totally free of any compromising influences. As long as Wade remains on the case, this unnecessary perception will persist," Merchant continued.

This is Freeptarding at its worse. Nothing prevents President Trump from serving as President even if he were to lose every count in Georgia.

A state court cannot place a Bill of Attainder on a candidate for president, or perhaps you weren't paying any attention to Trump v. Anderson just 10 days ago. Or perhaps you just like the taste of your foot in your mouth.

Secondly, McAfee's decision punts this case until after the election. Fanny will have to make the choice, and then fight to have those three stricken counts re-installed, and then try her case. If you know anything about the law (lol), there is zero chance that schedule can be completed in less than eight months.

Thirdly, you got one thing right -- Greasy should be in a bullpen somewhere cleaning up after the rodeo...

"Its time for Trump to get in front of this and show how much he cares for our country by saying he will withdraw his candidacy and give his delegates to DeSantis if he is convicted in Georgia, since the appeals process would take years to play out.

Although offending Trump supporters here is not my intent, it must be said that we put ourselves in this situation by not having a Plan B in place, which should have been keeping DeSantis in the bullpen."

Nathan Wade Resigns

Megyn Kelly is joined by Alan Dershowitz, author of “Get Trump,” to discuss Judge Scott McAfee’s ruling in the Fani Willis disqualification case allowing Fani Willis to stay but forcing Nathan Wade to leave, how McAfee tried to “split the baby” and have it both ways, and more.

“HOW TAINTED is she regarding any future office in Georgia???”

*************

Being tainted is a badge of honor in some states. What is obvious disqualifying corruption to us is a sign of political feistiness to others. Liberals want to win by any means. Nothing is out of bounds if it benefits them.

That’s where we are as a country today. The Left rewards malfeasance and the right refuses to punish it.

I look forward to hearing Trump’s comments about such a slut trying to prosecute him. Trumps should let it rip daily.

Most of the people I know and have known are “the right”... and they have no problem punishing “malfeasance”. It’s usually those on the left and those only pretending to be on ‘the right’ that have that issue.

Trump will be a convicted felon in Georgia this summer, and the appeals process will take years to work its way through the system.

Assume arguendo this is true.

So since Trump won't be able to serve when elected, Congress will elect Biden for a second term.

Assuming Trump WINS the election at the Electoral College, Congress does NOT get to elect anybody. If Trump is elected, Congress will get no opportunity to elect Biden in his place. If the Electoral College deadlocks with no majority winner, then Congress decides with one vote for each state.

As Trump is a natural born citizen and at least 35 years of age, why would he be ineligible to serve?

The terms of the President and Vice President automatically start at noon on inauguration day. The President cannot exercise the powers of the office until he has taken the oath. If Trump were ineligible or incapable to serve on inauguration day, e.g. he became as senile as Biden, the Vice President would exercise the office of President.

Since this a state and not a federal crime, Trump can't pardon him self.

Undeniably true, but makes no apparent legal point. In any case, Trump could not pardon himself (itself an untested dubious matter) until he was actually President and had taken the oath of office.

So since Trump won't be able to serve when elected, Congress will elect Biden for a second term.

No evident reason why Trump would be unable to serve when elected has been presented. The qualifications are specified by the Constitution. It might make it difficult for Trump to get elected, but the premise here is that he is elected. If Trump is elected by the Electoral College, Congress does not get to elect someone else.

The Republicans will rightly point this out and push to nominate Haley.

The Republicans cannot rightly point that out as it is not right. If the Party should choose to commit suicide, it could try to push Haley. They could try Liz Cheney or Mitt Romney to similar effect. The RNC, hand-picked by Trump, is unlikely to be suffering from TDS.

It should also be noted that the assumption that Biden will be the Democratic nominee is not necessarily correct. At the appropriate time, Biden can step aside and the DNC can select someone else, such as Gavin Newsom.

Amendment XX

Section 1.

The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.

- - - - -

Amendment XXV

Section 1.

In case of the removal of the President from office or of his death or resignation, the Vice President shall become President.

[...]

Section 3.

Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President.

Section 4.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

- - - - -

Amendment XII

The electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;--The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted;--the person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice . . .

- - - - -

Article 2

Section 1, Clause 5

No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States.

Dershowitz came back on the show yesterday calling himself "Nostradamas" - it was exactly as he predicted - the judge would "play Solomon" and try to have it both ways. He threw a bone to the defense earlier with his dismissal of a few of the charges - Dersh said this was the first clue that the judge was going to rule to keep Fat Fani on the case.

I believe nothing will further come of this for Fani.

Hope that cowardly judge loses his next election in a landslide.

It is Black Fani. To rule against her would label the judge as a first class, abominable racist.

She is Black and can do no wrong. Her ass must be kissed.

I get what you’re saying as those on the Right support law and order as a general principle. They also believe in the concept of accountability. However, the problem is that the people we elect rarely take those on the Left to task. There’s usually just a lot of rhetoric but little if anything in the way of serious push back or consequences.

Because of that the Left simply has no fear or respect for the Right. They know the Right lacks the will to punish them. Trust me on this — I worked around lots of liberals and this is their mindset.

You have a valid point. We (those of us on the right) have not truly been represented for decades. Those voted into office make lame promises and once in, they proceed to ignore what we wanted and do as they please. But by that standard they are only pretending to be ‘on the right’... since they are, IMO, acting more like those on the left. If you will notice, the reps that truly are on the right always at least attempt to fulfill the common-sense promises they made. I’m talking about reps like Abbott, DeSantis, and yes, Trump, too.

You have my sympathies re: working around liberals. One reason why I detested working for big corporations... the idiotic liberal corporate environment and all of the BS that comes with it. It’s even worse since 2009, as if that could have been imagined back then. One thing I learned quickly and consistently. If the company you work for suddenly starts insisting on doing liberal corporate crap like wasting time on “values brainstorming sessions”... start looking for another job. They’re covering for an impending collapse. And like true liberal idiots everywhere, they’re too stupid to logic out that forcing employees to waste more time on stupid PC stuff is only going to tank the company faster (duh).

One of my (few) conservative colleagues was very outspoken and not afraid to point out liberal hypocrisy. The libs running the place humored him in a condescending way, as they are want to do. They tolerated him because of his seniority, high level of education, likability, and skills. Lacking those attributes he probably would have been been pushed into a corner somewhere so they wouldn’t have to interact with him.

I had a very conservative, outspoken (like myself) boss once at a big oil company. He was so popular, that he had a literal harem of ex-assistants. We would all get together once a month for a luncheon, with him as the guest of honor. Anyway... this guy let the corporate bigwigs know what he was thinking... once too often. They finally got enough of it and transferred him to the Dubai location. His harem was devastated. But nothing lasts forever. Lesson was... yeah, lefties will tolerate you for a while, but eventually they’ll ‘Siberia you’. It’s how they roll.

True. But they’re too gutless to try that on their own. As well they should be.
