Blogger admits Hawaii birth certificate forgery, subverting Obama claims (Uh-oh)

Jay McKinnon, a self-described Department of Homeland Security-trained document specialist, has implicated himself in the production of fraudulent Hawaii birth certificate images similar to the one endorsed as genuine by the Barack Obama campaign, and appearing on the same blog entry where the supposedly authentic document appears.

The evidence of forgery and manipulation of images of official documents, triggered by Israel Insider's revelation of the collection of Hawaii birth certificate images on the Photobucket site and the detective work of independent investigative journalists and imaging professionals in the three weeks since the publication of the images, implicate the Daily Kos, an extreme left blog site, and the Obama campaign, in misleading the public with official-looking but manipulated document images of doubtful provenance.

The perceived unreliability of the image has provoked petitions and widespread demands for Obama to submit for objective inspection the paper versions of the "birth certificate" he claimed in his book Dreams from My Father was in his possession, as well as the paper version of the Certificate of Live Birth for which the image on the Daily Kos and the Obama "Fight the Smears" website was supposedly generated.

Without a valid birth certificate, Obama cannot prove he fulfills the "natural born citizen" requirement of the Constitution, throwing into doubt his eligibility to run for President.

McKinnon, who says he is 25-30 years old, operates a website called OpenDNA.com and uses the OpenDNA screen name on various web sites and blogs, including his comments and diary on The Daily Kos. In recent years he has divided his time between Long Beach, California and Vancouver, British Columbia. He is a Democratic political activist, frequent contributor to the left wing Daily Kos blog, and a fervent Barack Obama supporter.

So the Honolulu to Kenya route was Honolulu-San Fransisco-New York-London, then a once a day London to South Africa route via Rome and Khartoum, then Nairobi, leaving at 19.00 and not arriving until 9:15 the next day. This would take at least 48 hours, probably more.

It defies credulity that the first flight in a young woman’s life would be as a pregnant woman flying half-way round the world, on a grueling 3-day multi-stop trek, in the process risking the health of the baby.

Where the U.S. Citizen is the Mother

As mentioned above, the statutes prior to 1934 did not permit the transmission of citizenship through a U.S. citizen mother. However, the 1934 Statute permitted either the father or mother to transmit U.S. citizenship. This was construed as also authorizing the transmission of citizenship to an illegitimate child born abroad on or after May 24, 1934 to a U.S. citizen mother. However, the 1934 Statute did not apply retroactively to births prior to May 24, 1934.

The 1940 Statute was the first to specifically adopt provisions regulating the status of illegitimate children. It provided that, where paternity had not been established before the child reached the age of 21 through legitimation (normally accomplished by the marriage of the child’s parents) or court adjudication, an illegitimate child could acquire U.S. citizenship through its citizen mother as long as the mother had previously resided in the United States or one of its outlying possessions. .

The 1940 Statute applied to illegitimate children born either before or after the date of its enactment. While it did not confer U.S. citizenship on an illegitimate child of a U.S. citizen mother who had been legitimated by an alien father prior to the child reaching the age of 21, it did not adversely affect the status of anyone who acquired U.S. citizenship prior to such legitimation. Children born on or after January 13, 1941 could acquire U.S. citizenship at birth under the 1940 Statute and did not lose such status, even they were later legitimated by their alien father. Further, children who were born after May 24, 1934 but before January 13, 1941 could acquire U.S. citizenship at birth under the 1934 Statute and did not lose such status as a result of the 1940 Statute, even if they were later legitimated by their alien father. In other words, an illegitimate child born to a U.S. citizen mother and alien father would only be denied citizenship if he or she:

1. was born before May 23, 1934;

2. was legitimated before reaching the age of 21; and

3. was legitimated before January 13, 1941(the effective date of the 1940 Statute).

In light of the 1994 amendment (discussed below) which retroactively authorizes the transmission of U.S. citizenship by U.S. citizen mothers to children (legitimate or illegitimate) born prior to May 23, 1934, the issue of legitimation by an alien father is no longer relevant to the transmission of U.S. citizenship by a U.S. citizen mother to an illegitimate child.

The 1952 Statute provided that an illegitimate child acquired U.S. citizenship from a U.S. citizen mother if the mother was a U.S. citizen at the time of the child’s birth and had been physicially present in the United States or one of its outlying possessions for a continuous period of one year. This provision did not adversely affect the status of anyone who had previously acquired U.S. citizenship. This provision is still in effect.

It's inconceivable that newlyweds would go on a honeymoon.

Stanley Ann had compelling reasons to visit the folks before she had to travel with a baby.

You are libeling Stanley Ann by saying you think she's too stupid to figure out how to get her and her new husband off to visit his parents.

IMHO besides getting knocked up in the first place, she made one small mistake, she didn't realize that the airlines wouldn't fly her back when she could drop the kid at any moment.

She wanted her kid to have unquestionable American citizenship. She feared that the US wouldn't recognize her polygamous marriage, and believed that illegitimacy required him to be born on US soil.

The plan was visit the folks over the summer, and be back in time for the joys of childbirth. Then the airlines blocked it. What now?

She tried to make it so, at least on paper, as soon as he was born.

Get him back on US soil immediately and claim he was born there. What reason did the civil service clerk have to doubt her story when she came in with an itty-bitty baby (oooooooo! he's so cute) that he was born anywhere but on the island?

That first little bit of paper starts the process of "proving" he was born at home in Honolulu, with no midwife or physician attending...

So Stanley Ann had compelling reasons to believe that little baby Barak would not be regarded as an American citizen should anyone think he was born in Kenya to a mother who was not legally married (due to polygamy) and hadn't been in the US for a continuous period of one year?

No one is yanking my chain. Although curious enough to read my way through the thread and contribute information (more often than not SOURCED WITH LINK PROVIDED) as I felt might be useful, I never maintained ANY personal opinion as to the place of his birth.

The validity of the document shown on the obama site remains open to question and challenge as ANY document shown on a website is open to such.

That leaves only the possibility that his passport is wrong in listing Honolulu Hawaii and only deliberate fraud by him or his mother (even lying to Barack about his place of birth) took place. You have to believe (a) they wanted to commit fraud and (b) they somehow succeeded. Neither is at all plausible.

Yeah. It's inconceivable that someone would want American citizenship for their baby badly enough to lie on a government form.

Yeah, and from a teen-age girl who got pregnant in college from a "fellow traveler" from Africa who was already married, wooing her as his next conquest, who ultimately dumped her for a third "wife."

She couldn't have known about the third wife, but her critical thinking skills were already suspect.

But she wouldn't lie on a government form.

I’m still locking for a direct source but so far I have provided the gold standard of sources by the USSC ruling. However here is another secondary source for those who are not married to an error: Interpretation 309.1 Acquisition of United States nationality by illegitimate children.

The Henry Chang opinion looks like a real legal opinion. I would still like to find the actual statutes and tie them to effective dates and events at issue but if it is as simple as a consistent statute from 1952 on nationalizing illegitimate children where the mother is a US Citizen, with no conditions, that will be the answer.

I'd like to think about the ramifications as applied to the possible Obama facts. I have paid less attention to the Sec. 1409 issue the last several days because I believe Obama's story is correct that they were in fact married in February of 1961; and I think the most logical course of events is that the marriage occurred in Kenya where it would have been valid.

Under those circumstances, I assume we would conclude that Sec. 1409 has no application.

The great circle route is all very interesting but the airline routes available don’t go that way. Besides, Obama Sr. was not in Boston in August of 1991, at least on the current record.

Unfortunately he wasn't born at Coco, according to his birth documents posted here yesterday evening, he was born in the French hospital in Colon, well outside the zone.

This is contradicted by the following quoted from the source I linked to earlier.
As I reported earlier, the McCain campaign has declined to publicly release the senator's birth certificate. But a senior campaign official showed me a copy of his birth certificate issued by the "family hospital" in the Coco Solo submarine base. (McCain's grandfather commanded the Coco Solo Naval Air Station in 1936; his father was the executive officer of a submarine based in Coco Solo.)

The birth certificate was signed by Captain W. L. Irvine. I have now checked that name against the Naval Register for 1936, and I find that William Lorne Irvine was director of the medical facility at the submarine base hospital in Coco Solo, Panama Canal Zone, during that time period. You can see the entry here. I think this effectively disposes of any remaining doubts that McCain was born inside the Canal Zone.

I believe so although I have not looked at the law on that question in some time. Validity in the US may not be the test either unless the person (child) was born here in which case it would not make any difference on the citizenship.

When she came back from the romp I'd imagine that's when her mother and father adopted Obama and gave him his present name.

that caught my eye...because IIRC, when obama 'helped' to put through that amendement re John McCain, it was mentioned there was an attempt to include offspring of military personnel. (Don't tell me I have to go back and find it!)

Obama himself in his book refers to the marriage of his parents as something he didn't want to go into...(paraphrased) - it's my belief that marriage, if it took place, may not have been valid.

As the adopted child of Stanly Dunham, I can conjecture he may have thought his problems were over:

It’s funny how people will wrap false, defamatory speculations around the 1st amendment when challenged, rather than defend the claims themselves. The claim that Barack was born anywhere but Honolulu is a bizarre and false claim with no basis in fact.

One good reason to be circumspect in making accusations against her. Do not speak ill of the dead, as they say. she is not running for office and cannot defend herself against wild claims. While I agree about BHO Sr probably not being in Boston at that time, what what do you mean about available routes? I find it hard to believe that in '61-'62 time frame somebody wasn't flying from Hawaii to Seattle, or Vancouver which is pretty nearby and wouldn't change the numbers much, I was just responding to your comment about it being quite a detour. It's not. Airlines fly great circles because they are the shortest route between two spots.

Incidentally that website doesn't just use the spherical earth approximation with a closed form solution, which really isn't that great over a couple of thousand miles distance. It uses the WGS-84 ellipsoidal earth model. The Spherical model is still pretty good out to 600 miles or so, and very good over a couple of hundred miles. Practically speaking even the spherical model will probably let you at least find Hawaii, even from Tokyo or some Indian port, it just won't put you right in the harbor mouth.

This State of Hawaii link indicates that by '61 several airlines were servicing multiple US cities direct from Honolulu.
