Blogger admits Hawaii birth certificate forgery, subverting Obama claims (Uh-oh)

Jay McKinnon, a self-described Department of Homeland Security-trained document specialist, has implicated himself in the production of fraudulent Hawaii birth certificate images similar to the one endorsed as genuine by the Barack Obama campaign, and appearing on the same blog entry where the supposedly authentic document appears.

The evidence of forgery and manipulation of images of official documents, triggered by Israel Insider's revelation of the collection of Hawaii birth certificate images on the Photobucket site and the detective work of independent investigative journalists and imaging professionals in the three weeks since the publication of the images, implicate the Daily Kos, an extreme left blog site, and the Obama campaign, in misleading the public with official-looking but manipulated document images of doubtful provenance.

The perceived unreliability of the image has provoked petitions and widespread demands for Obama to submit for objective inspection the paper versions of the "birth certificate" he claimed in his book Dreams from My Father was in his possession, as well as the paper version of the Certificate of Live Birth for which the image on the Daily Kos and the Obama "Fight the Smears" website was supposedly generated.

Without a valid birth certificate, Obama cannot prove he fulfills the "natural born citizen" requirement of the Constitution, throwing into doubt his eligibility to run for President.

McKinnon, who says he is 25-30 years old, operates a website called OpenDNA.com and uses the OpenDNA screen name on various web sites and blogs, including his comments and diary on The Daily Kos. In recent years he has divided his time between Long Beach, California and Vancouver, British Columbia. He is a Democratic political activist, frequent contributor to the left wing Daily Kos blog, and a fervent Barack Obama supporter.

I would say it would be very prudent to keep digging deeper and never let up till the cows come home in November...

You are the one that suggests everything is so cut and dried that it cannot be an issue worth proceeding on, and at every turn you have basically throw the same at me when I have dared to suggest that the law leaves room for things not described in it in full detail.

If the law were so prefect so absolute as you have suggested there would be no need for lawyers to argue it or defend it.

Our rights are given away by treaty all the time, in fact you may not realize this but outside of our borders our rights are almost nonexistent in other countries.

The only rights we have outside of our borders are guaranteed by those treaties you would ignore for the sake of Obama’s candidacy.

A more recent example is the execution Texas carried out the other day. The US has signed a treaty but the Supreme Court found that the provisions of it couldn't be carried out constitutionally. The Constitution trumped the treaty.

It's not that I would ignore them, certainly not to support Obama's candidacy. It's just that the Constitution is important. The idea of giving the rights conferred by it away via treaty is unacceptable.

If Obama's not eligible because he is not a natural born citizen that's fine. If he was born on foreign soil he likely isn't. But if he was born on US soil you would have to strike at the heart of the Constitution to take his eligibility away. This election isn't so important that the Constitution should be suspended.

I have not read the decision about the Texas execution although I am aware the case exists--I believe from reading general law periodicals that the Court held the treaty did not preclude the execution because Texas due process complied with the treaty requirements.

The rule of law is that treaty obligations do control. But there are obviously a number of places where they do not dictate a result contrary to domestic law.

There isn't any real doubt either that even if Obama was born in the US (and I know of no real evidence that he was), there are things he can do to lose his citizenship and I assume also things he can do that would preclude him from being eligible to act as President.

However I tend to doubt that the Supreme Court is going to hold him ineligible if he was born in the US. Not actually knowing what the facts are on the subject. We can come up with hypotheticals where the argument for disqualification is stronger and might control the result.

What about having to reaffirm his citizenship at the age of 18? Wouldn’t he needed to do that if his father, at that time, had British Citizenship?

I am not sure he did any of the things that are prerequisites to the requirement that he do so.

And he has some other sovereignty issues which exist even if he was born in the US. The Judah Benjamin articles are very good on the concept.

And we don't yet know enough facts to know for sure how any of these requirements would operate.

However, from a political perspective, rather than a pure legal analysis, if it turned out that he was born in Hawaii (and I know of no evidence that he was), I think it is likely on the factual record before us now that the Courts would hold him eligible.

It’s a pretty big stretch to say we should ignore our treaty obligations on dual citizenship because Texas executed a murderer.

Mexico I believe doesn’t recognize dual citizenship at all. Their complain was what? That it was illegal for the United States to execute one of their citizens that committed a crime here?

It is likely that he has political, and potential legal sovereignty issues with respect to his citizenship record, many of which issues result from Hawaii Birth Certificate filings.

It would not surprise you to learn that his most recent filing is one made around the time Stanley Ann returned to Hawaii with the half sister and was cleaning up the sister's citizenship and Birth Certificate record--which filing may well have been in the Barry Soetoro name.

Nor would a filing prior to that time but after the original birth filing at the point he was adopted by the second husband surprise you either--if he was in fact adopted.

But the significant filing that ought to count for purposes of the Article II, Sec. 1 test is the original birth filing, if any. Because the issue is where he was in fact born.

Suppose he comes back with unsealing one or more of the intervening filings (but not the original) and says "well there has been uncertainty about my birth and birth certificate because my mother had a second husband who adopted me but under these treaty provisions and statutory provisions, I couldn't lose either my natural born or actual birth citizenship in the US because I never swore allegiance or served in a foreign army. I know the stuff is confusing; and I can see the negative political impact; but it really makes no substantive difference to my eligibility to act as President nor to my actual citizenship. (By the way, I haven't had my original birth record unsealed--we all know it was in Hawaii.)"

What Nixon would have called a limited hangout. Maybe buttressed by a written statement from his real grandmother (Stanley Ann's mother) which says she was there when he was born in Hawaii.

Just today, courtesy of the Rocky Mountain News, we confirmed that Barack aka Barry Soetoro Obama was a citizen of Kenya since 1963. Barack has yet to stipulate when he renounced or relinquished that citizenship.

How is it possible for Obama to be a citizen of Kenya and the US when that country doesn't permit dual citizenship? Obama might have been eligible for Kenyan citizenship, but according to this, his failure to renounce his US citizenship by age 23 would result in automatic loss of Kenyan citizenship.

If such a person wishes to retain Kenya citizenship, he/she is advised to renounce other nationality before the age of 23 years. Failure to renounce results in automatic loss of Kenya citizenship after age 23.

Many don’t realize you don’t need a birth certificate to get it. So that could have been human error.

In one of life's little ironies, recently I needed to sign a notarized authorization to get a certified copy of my birth certificate.

The notary would not accept my passport as ID...

I think in that case he wins. At least politically. It would muddy up the issue so badly that the electorate would be so confused that they would avoid thinking about it.
