Earlier this week there was a thread requesting Freepers to contact their state election boards to request proof of eligibility for Barack Obama.. I complied and made the request to the Tennessee Election Commission . I received a response from the commissions attorney a Ms Cara Harr. It took all week but the request finally was provided by fax on Thursday October 30.
The request to the Election Commission demanded the candidate Barack Obama provide immediately a birth certificate proving eligibility and compliance with the constitutional requirements.
Ms Harr indicated that the Democratic National Committee had provided such certification. I requested a copy of the certification document and it was faxed several days later after two more e mails and three phone calls.

It only shows that the Dems nominated him.
And we’re to take their word for it?
All the certificate says is the guy was nominated. It doesn’t say he met the Constitutional requirements to hold the office.
If we stick at it, hopefully, people will go to jail for fraud.
This just shows that the convention of the party nominated someone going by the name of Barack Obama.
They apparently did not care whether he met the constitutional requirements.

No, it says that they certify he was "duly nominated." That means the DNC owns the responsibility for having checked his qualifications.
If Obama is found to be ineligible, this certification amounts to an admission of guilt.
Is any state election board going to do anything to block the Coronation of The Messiah? I doubt it.

sounds typical. Last week, my State EC transferred me to the DNC and the guy got t-ed off at me and then hung up after I politely stated my request. He was clearly very irritated , he said he was busy and didn’t have time for my call and hung up on me.
CALL FOR ACTION:
Please, all Fellow FREEPERS, please consider doing the following to prevent this mess ever happening again:
Call your State Senator, your State Representative and your Governor and ask them to provide simple legislation to give the Secretary of State the right, responsibility and obligation to confirm eligibility BEFORE ANYONE can go onto the ballot.
Personally, I think the best way to contact them is by phone during business hours, then a follow up by e-mail or mail to the person you talked to, then a follow-up a week or so later, but you can do what you think is best.
Practically, this would require all future candidates to fill out an application with supporting documentation, which could then be checked out by the Secretary of States office.
I dont know about you, buy THIS idea seems a better use of our governments time then providing yet another social program designed to ruin people by not having them be accountable to their families (a basic problem).
If there is an enterprising lawyer or legislator on Free Republic who would like to provide well written sample legislation which could be submitted as a suggestion across the country, it would provide a basis for continuity.
Hope there are many, many people across the country who are willing to do this now, and after the election.

I agree...this just says these people were nominated. Says nothing about being eligible. When I sent out my dozen requests to various agencies within my state (Florida). my state of birth (Alabama) and Washington DC...I couldn’t even find out what is the authorizing agency that oversees qualifications for the offices of President and Vice President. This is something that needs to be changed before the next elections. It is an absurdity that needs to end! We only have two items of eligibility...age and natural born citizen...and we don’t even require proof of either which could be done with a simple live birth certificate. We waste our time on finding out if someone is wealthier than we are, etc etc...but not if they are eligible under the Constitution (as it now stands).

It would appear that the certification document provided perhaps sidestepped request. The document provided indicates that the DNC did certify its nominees but says absolutely nothing about eligibility in accordance with the constitution. It would appear that in Tennessee, party nomination and certification are all that is required for placement on the ballot. There seems to be no effort to ascertain that the candidate meets the constitutional requirement for eligibility.
This is where there are problems with the laws. I examined the Virginia code, and it works the same as in all the states where voters are concerned about this: the parties are responsible for the eligibility of their candidates; however, the state election officials are responsible for upholding election laws (notice I did not say enforcement) and, I believe, the Constitution. If the eligibility is a problem, then the party at fault is the DNC. It’s possible that by not putting forth a legitimate candidate, if that turns out to be the case, the DNC would have restricted the first amendment rights of the people of each state. I am not a constitutional lawyer and I don’t play one on tv, though.
