Attacking the TSA for its privacy-invasive screening procedures has become a favorite activity for many journalists, especially Matt Drudge. TSA horror stories are often featured prominently on The Drudge Report and he has taken to calling Janet Napolitano, Secretary of the Department of Homeland Security (of which the TSA is a part) “Big Sis.”

Might be an interesting suit, although the blogger would be dragged over the coals.

For any lawyers: How might the plaintiff show damages?

Until people stand up as one and say enough is enough there will be no changes. A two week boycott of all air travel will quick bring this to a head and force some real change.

The problem with that is business travel will never join a boycott. When my boss says fly, we fly. I would much rather drive to Nashville or Chicago (each doable in under six hours for me) but they want us back the next afternoon or sometimes the same day (an incredibly exhausting pain.)

If it's true, then it's not libel. IMO.

Yup, I can hear the argument now. It is not rape, since it is under color of law, like a strip search at a jailhouse is not rape. Therefore, to call it rape is defamation. It will likely be thrown out, although since it is an accusation of a specific crime with specific elements, it might get to a jury. No matter what, the poor victim will continue to suffer at the hands of these bastards. (Oops, will I be sued for calling them bastards when they may have actually had a father).

Vaginal penetration without consent is rape. Especially if the blogger cried out against what was being done to her. That would have to legally constitute withdrawal of consent if they tried to claim that she had somehow consented by letting the search begin in the first place. Anything that TSA agent did after that point (IOW, the other 3 times of vaginal penetration) would technically and in fact be rape - carnal knowledge without consent, and with specific and public protest of the act.

In order for it to be “under color of law”, I would think that TSA agent would have to produce official guidelines or instructions regarding vaginal searches and what constitutes permission for a vaginal search.

This whole story is sick, sick, sick.

TSA screening procedures have already taken a toll on the Fourth Amendment;

Whats wrong with customs doing their job? They intelligent enough to ask questions, afraid of profiling? Or just plain stupid?

Here in Thailand, Defamation suits are a means for shutting up the political opposition. Nice to know the USA is catching up. ;-)

Hannity and others are wrong to buy this line and repeat it to us as I have heard them say.

It should be mandatory for all the congress critters that let the TSA get away with it. Their wives and daughters and sons should have to go through it also...no private planes for them.....until after the search...and especially the female congress critters that allow this to continue...In a line in public just like the rest of us serfs...

The cards (which are her own composition) refer to the driver as a "Road-Hogging, Gas-Guzzling, Air-Fouling Vulgarian" and pointedly suggest that the driver is compensating for "an extremely small penis" by driving "such a monstrosity."

Maybe she is telling the exact truth, but her accusations would have much more credibility if she were not a professional complainer.

It does make it easier to dismiss her as a drama queen, not that this particularly helps the TSA agent’s proposed lawsuit, because the agent could always say “consider the source” about this blogger.
