Probate

III. Guardianship

1. On the Petition for Appointment of Emergency Temporary Guardian, Judge Greer feels that it should be brought to the Court only in a circumstance of life, death or substantial waste of property.

I don't really see this as a conservative cause, but it is being portrayed that way and I guess the main supporters are conservatives.

The fact is this case stinks to high heaven.

MS has lied to the courts over and over again and Judge Greer continues to look the other way. In the beginning the husband had a very large monetary reason to refuse rehabilitation for Terri and then to "remember" years later that it is Terri's wishes to be removed from her feeding tube and not given water. He should have been removed as her guardian years ago when he did not fulfill the requirements for a guardian set by the staten. Now, according to the husband, after paying his attorneys most of Terri's money, there is only $50,000 left (which isn't chicken feed). He must be continuing his campaign to kill Terri for spite or maybe as some here speculate he and Felos are in a collaborative effort on a book about Terri.

I would like to see more pressure put on this judge. He has been very bias throughout the years towards the husband and against Terri's parents. Maybe the pressure could come through his Church? Does anyone know the name of it or the email address? I heard they are supporting the parents. I would like to see what they have to say about the matter.

There's at least one more Schiavo brother ... and this one has a different story:

" And when the couple went to his grandmother's funeral, Scott Schiavo says, Terri Schiavo told him she would not want to be put on a respirator, as the grandmother had been. "

FYI...

Another email from my nonFReeper friend:

"Having done much research I was able to focus on the facts and Mr. Schiavo was less than honest in the LK interview.

After the Larry King show where Michael Schiavo talked about Terri having a 2.0 potassium (K) I started asking questions. I already knew that the EKG was normal. I felt that something was wrong with his allusion to bulimia. How can a person have K that low and not have evidence on an EKG?

So, I looked into it.Actually, the potassium (K) was low on admission to the hospital. Terri did not have a heart attack, her cardiac blood enzymes were not elevated, her heart stopped.

There is no evidence that I have been able to find of a history of K imbalance or any other evidence of bulimia such as erosion of dental enamel. There are other tests that go hand in hand with the K being that low. Normal K is 3.5 - 5.3 mEq/L. Below 3.5 mEq/L there are marked changes on the EKG (depressed ST segment, flattened T waves, and prominent T waves).

But, the EKG was normal. It drove me crazy. How could the EKG be normal if the K was so low? Why were other markers normal?

I emailed all the nurses I know and kept asking "Am I missing something"? Finally I got the labs and the interpretation. Blood sugar was 376. K was 2.0. All other labs normal.

The EMS had given Terri IV solution which contains a sugar , probably D5W, before she got to the hospital. She was most likely over hydrated and this influenced the K results.

Dr. Hammesfahr does not think the K was a factor in the cardiac arrest (heart stopped) and heart attack was ruled out.

Now, Michael Schiavo is a nurse that really should know better and he has all the doctor's reports. I fear that he was leading us all down the garden path yesterday with his implications of bulimia and electrolyte imbalance."

But if we think about what Steven is claiming and that her parents were so bankrupt that the couldn't even get credit to get an apartment

This might fit with some questions I've been waiting to see answered. I heard the Schindler's attorney, Pat, on Glenn Beck yesterday. She confirmed that Terri had experimental brain surgery (as opposed to external stimulus, such as electro shock as some have speculated). She said it was done in San Francisco, I think in 1991, but definitely before the malpractice trial. She said Terri was in San Francisco for 1 month, then in the rehabilitation facility in FL for 3 months, which was the last time she had any rehab.

This brain surgery raises a lot of questions. Did the Schindlers approve of Terri having brain surgery? Are the probes that were implanted in Terri's brain still there, or was there a second surgery to remove them? Might more damage have been done to Terri as a result of this experimental brain surgery? (Surely there'd be extensive work-ups of Terri's brain functioning and status pre and post-operatively. I'd imagine that would have to have been in the medical evidence presented at the malpractice trial. Since it would've been used in discovery, wouldn't that make it public domain?)

Finally, as relates to your question about the Schindler's financial situation in 1991: I don't believe any health insurance company would have paid for experimental brain surgery! It had to have been incredibly expensive, and I doubt Michael paid for it. Is it possible the Schindlers paid for Terri's brain surgery? If so, that could sure account for them being bankrupt in 1991.

Dem Senator jumping on bandwagon.  The Florida Legislature sent living will material to all districts last week following the passage of 'Terri's Law'.  Wonder if the bill Nelson is sponsoring uses the likes of Felos to 'educate'.

Schiavo and living wills

In court today, there's a move to appoint a guardian ad-litem for Terri Schiavo, under the new state law that kept her on artificial feeding. Meantime, her husband Michael will be in court to have the law thrown out. US Senator Bill Nelson is sponsoring a bill to spend 25-million dollars to educate people on living wills. The elderly, in particular, would be advised to put their wishes in writing before they're incapacitated.

I don't really see this as a conservative cause, but it is being portrayed that way and I guess the main supporters are conservatives.

Nor do I, but people are dividing up along party lines. You should read some of the posts on usenet rather than just read here (even here there are more negative voices than you might expect). It's an uphill battle for Terri. I think even those loving parents are prepared to let her go if they can just have her back to love and comfort her and obtain justice and humane treatment for her.

The fact is this case stinks to high heaven.

It does to me, too. My heart goes out to the Schindlers. What a hell on earth for them to have their daughter in the clutches of someone who seems to want to be rid of the burden no matter what it takes.

He should have been removed as her guardian years ago when he did not fulfill the requirements for a guardian set by the staten

I simply do not understand how he has been allowed by the court to remain her guardian because of the glaring conflicts of interest. All that talk about loving her is just a smokescreen for his true motives imo. If he has attempted, as has been alleged, to withhold medical treatment from her, that is criminal neglect imo. Same goes for all parties to same.

I would like to see more pressure put on this judge.

I refrain from judging him on the sole basis that he hasn't done what I would want, but I seriously question that he has ruled in an unbiassed manner. I don't know where some of these judges are coming from any more. There are so many laws on the books, they seem to be just shopping for the ones that fit their agenda and disregard the rest.

Maybe the pressure could come through his Church? Does anyone know the name of it or the email address? I heard they are supporting the parents. I would like to see what they have to say about the matter.

Terri's parents are catholic and she and Michael were probably married in a catholic church. However, I did read somewhere that he was raised Lutheran, and have no idea what his current status is. Maybe he converted; we don't know.

Because of the horror of the sex abuse scandals, the church seems to be lying (laying?) low. The catholics in America are unpredictable and seem to split along "party" lines on the various issues, so I don't see them coming out in a solid block of power on Terri's and her family's behalf. Catholic teachings are more for life than any other religion I know.

There are a few catholics who are speaking out, but not enough. What happens here is going to affect us, our children, and our childrens' children and should be a wakeup call for everyone. Kudos to that priest, Father Rob Johansen who has gone to the vigil site from Michigan and kudos to his superior who gave permission for him to leave his regular duties to help in Terri's cause. Kudos to that old priest who did his best and has been under horrible stress for a man his age.

I hope we will hear more from the church. If all the catholics got on board and presented a united front, it could make a tremendous difference. Also, I'm deeply grateful to all those protestants and all others who are fighting for Terri. The ones who seem to be coming down against Terri seem not to have any guiding religious beliefs that have any transcendent values.

What is really ugly about some of this is that I suspect many have done the same thing to their own relatives and can't stand the light of moral scrutiny and introspection concerning their own actions. They look at this and wouldn't want to be burdened by a loved one who is of no use to them any more, and they respond accordingly. Love quickly waxes cold when things get inconvenient.

The only difference as I see it is that his brain still functions normally, unlike MS. Otherwise I see no difference between the two cases.

Re: Chris Reeves. On that point, if Robin Williams hadn't stepped up to the plate and offered to pay for Reeves' care (at the beginning it was said to cost $400,000 per year) then Reeves himself would be in a bind. I don't think he had quite the money Williams does.

He may not have gotten the therapy he needed, which is what happened to Terri. He might just be lying there in a bed unable to speak at this point too.

Interesting. Last year I was admitted to the hospital after fainting and the admitting doctor said I had no descernible traces of potassium and wanted to know why my heart was still beating?

After 2 days of hydration my reading were all normal and never yet got an explanation other than 'high stress'.

MS: I believe in the vows I took with my wife, through sickness, in health, for richer or poor. I married my wife because I love her and I want to spend the rest of my life with her. I'm going to do that.

Interesting. I read some other quote from him that he considered Terri to have been dead since 1990. His brother said that I think. And MS said in another quote that she died in his arms.

Au contraire. He's had the best that money can buy, including regular, aggressive therapy to keep him from deteriorating faster. People rallied to help him and came up with the money and probably still do.
