Bummer! I ordered a yard sign on the Internet, a beautiful McCain-PALIN sign! I vote! I live in America! I live in the deep South, even! But I also live in a covenanted community, a golf-course community full of stepford wives and pissy no-tolerance types who run the Homeowners' Association. And I just read the following on their web site:
Section 15. Signs. No signs shall be displayed upon any Lot or Living Unit other than a sign identifying the name of the contractor during construction of a dwelling . . . provided said sign meets the design criteria of the DRC and does not exceed eight (8) square feet in area, and provided, further, than any mortgagee who may become the Owner of any Lot or Living Unit may place a For Sale sign on any unsold or unoccupied Lot, provided that the design, color and size of any such sign shall have been approved by the DRC.
Do I live in America? Is this the land of the free, home of the brave? Well, I am brave enough to put up the yard sign, and brave enough to ignore a certified letter telling me to take it down (they do that here . . . they can't just knock on your door like normal people). But, I don't want to lose my McCain-PALIN sign! This is America, damn it! Or is it?
Once you sign up for a HOA it’s not. HOA’s are evil, have been for a long time, good that you’re finally learning this.
Put it up and keep your video ready and be ready to call the media when they fight you on it.

And you agreed to their rules in exchange for something? Do they maintain the streets or sewerage? Get yourself a few dozen acres and plant all the signs you want!

Can you give me a compass heading to a few dozen acres in the Tampa area that doesn’t cost a fortune? Last time I looked I found a nice 7 acre plot for only $1.4 million and only an hour away.

I had a friend who complained about all the noise from the jets flying low over his house. I told him he shouldn’t have moved next to an airport.
So why don't you dump that tarpaper Souvrn shack and come on up here and buy one of our community's 8 (count'em, eight) homes and put up your signs 'till the cows come home!
Yep, it is America and you are free to enter into a binding contract and agree to abide by its terms. HOA sux0r but its what you agreed to. Work within the system to change it. Unless you are in a nest of libs, you should be able to get on the board and change the rules.
Here’s one thing I don’t understand. Do you own the property or does the HOA own it? I’d assume the individual homeowners have to pay property taxes. If that’s so, and the HOA has no legal authority, only contractual authority, what right do they to tell you what to do with your property? I mean, I know you have to agree to the terms of the contract before you can posess the property, but once it’s yours, I don’t see how they can enforce the contract. What am I missing?
Well, you signed the contract and agreed to put yourself under the tyranny of your HOA. No one forced you to do so.
I don’t think it would be permitted to restrict your political right to free speech anymore than putting up a sign that says “I’m not responsible if you slip on my icy sidewalk” would absolve you of responsibility.
The homeowners’ ass. can say it, but it doesn’t make it legal.
I have an HOA too. You sign for it at closing. Mind you, mine’s not as restrictive as yours, but I have to refer to it once in a while. I made the choice. I can’t complain now.
