"...a lawyer for one of them contends 14-year-olds have a right to privacy that allows them to consent to sex with each other, and has challenged the constitutionality of the law." I really don't think I'd want this case to come before the SCOTUS. At least, not the way it is currently constituted...

Don Linke, the boy's attorney, argues that children's privacy rights include the right to make "important decisions."
Children aren't ready to make important decisions like these. That's what parents are for.

We are overlooking the most important thing in this case. Were they going to use a condom?

I thought this was considered settled law, based on the high-caliber reasonings embedded in
the penumbra of lyrics from Cyndie Lauper and some rap artists.
(end sarcasm...even if it's probably effectively true)

Let them do it, for crying out loud.At 14, the girl is repeatedly spending the night out. It that what we should let them do?
I would be more comfortable if the charge was that the children are incorrigible, rather than focusing on sex alone. However, the prosecutor in her judgement decided that this was the charge that might stick. She is to be admired for taking on a case which could lead to her being ridiculed.

...the statute is intended to prevent older teenagers or adults from abusing or exploiting younger, more vulnerable children, not to prohibit consensual sex among teenagers. Exactly right. The INTENT of the law is to criminalize adults who sexually prey upon and exploit children. Criminally prosecuting two children for sex (which is not by force) is ridiculous.
This kind of action is why Statutory Rape laws and age-of-consent limits are under assault by some Liberals.

What is the story that is not reported?
The mother of the girl is a single mom and the girl's father was thus not present to beat the crap out of the 14-year-old punk.

Teenagers have a right to make decisions for having sex and abortions, however at 14 they are not legally allowed to work.
I'd say the age of "consent" should begin once you're old enough to stay out past curfew and earn a living, until then they're juveniles.

They are saying these kids have ADD? What a crock! If the girl is already on probation there is a much better reason for her(and his) "activities". It's called no parental guidance, and no but whippings. Why did the mother call the cops on her own daughter? There is obviously no adult around that ever really gave a sh*t about either of these kids.

No comment necessary. You just sigh.

The whole idea of charging kids with felonies for this is evil, beyond redemption.
My grandparents married at 15 and 14 - now, kids in the same circumstances are disabled of their voting rights, their rights to own guns, forever, why?
I get really angry about our societies bipolar disorder on this issue.
At seventeen, I was a machinegunner in the dreaded 82nd Airborne Division.
At 20, I got sent to CA - Still had my machine gun, but unable to buy a beer. WTF????

Neither is being named because of their ages. Don Linke, the boy's attorney, argues that children's privacy rights include the right to make "important decisions." "One of those types of decisions is whether to engage in sexual relations," says LinkeNeither is being named because of their ages, but they're old enough and have the right to make such important decisions as to play at STDs and death from AIDS, and bringing another human being into the world and having the maturity and means to care for it until maturity? Linke is one of those consciencious and wholesome family lawyers, right?
