What we have here is question of definition.

Article II - The Executive Branch, Section 1
"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President"

My assertion is that the framers were explicit and carefully chose the words "Natural Born Citizen" as opposed to just citizen as used elsewhere in the Constitution. Note the second part of the clause, "or a Citizen of the United States, at the time of the Adoption of this Constitution", which clearly means that they wanted to include themselves to eligible because some of the framers had foreign born parents. They unquestionably thought this through.

The term "natural Born" didn't need defining, at the time, as it was considered common knowledge.

"I am much obliged by the kind present you have made us of your edition of Vattel. It came to us in good season, when the circumstances of a rising state make it necessary frequently to consult the Law of Nations. Accordingly, that copy which I kept (after depositing one in our own public library here, and send the other to the College of Massachusetts Bay, as you directed) has been continually in the hands of the members of our congress, now sitting, who are much pleased with your notes and preface, and have entertained a high and just esteem for their author"?

It has been over 200 years and in that time "we the people" have forgotten our contract and its definitions and now are making excuses for political agenda. If we have no Constitution we have no country. This is a sad state of affairs for our nation and our country is soon to be lost.

I ask that you review these links. They are helpful in defining "Natural Born".

I’m not trying to imply that I’ve decided the birther thing is all a sham. Because I don’t believe that. There is definitely more to “natural born” than I previously thought.

The thing is, they seem to have relaxed the rules quite a bit over the last hundred years and It’s questionable what set of rules should apply...the current ones or the ones in effect at the time of a person’s birth? I don’t know. Also, precedent has something to do with it too. Sometimes the precedent doesn’t seem to jive perfectly with the letter of the law. Yet it’s the precedent that is respected, not the law. At least it is until another judge makes a new ruling to contradict the precedent. Then there’s a new precedent.

I think the “birthers” are technically correct. But nobody cares. So here we are. Birthers being made fools of by imbeciles that don’t care what the truth really is. All they care about is who they think looks sillier, then they take the opposing position so they can be one of the one’s pointing rather than one of the one’s being pointed at.

Well, I’ve got a pretty basic position mapped out for myself. It breaks down into three areas...

(1) I’m going to go by the official Hawaii pronouncement, unless something solid comes up (in a court of law) that disproves it.
(2) Since everyone wants to see the birth certificate, I’m going to continue to work for enacting a state law for that purpose (Oklahoma, Texas, Missouri and Azrizona already working on it).
(3) The issue of natural born, as far as parents and their citizenship, I’m going to let the Supreme Court decide on it and I’ll take their decision.

That’s where it boils down for me right now...

The Constitution was written before the statute. If there was not a universally understood definition of the term, the drafters would have defined it. They didn't, because they all knew and accepted the definition given by de Vattel.

As John Jay wrote in a letter addressed to Washington in his role as President of the Constitutional Convention "Permit me to hint whether it would not be wise and seasonable to provide a strong check to the admission of foreigners into the administration of our national government ; and to declare expressly that the command in chief of the American army shall not be given to, nor devolve on any but a natural born citizen."

To quote from the excellent exposition to be found at www.thebirthers.org/USC/Vattel.html, "Jay not only knew of Vattel, as can be seen from his correspondence with James Madison in 1780 during treaty negotiations with Spain, but he was also a proponent of Vattel as well. "

Well.., heck! The trouble is, that with a lot of others coming from other Democrat/liberal sites, it’s got people jumping all over other FReepers, too, because some don’t like the opinions other Freepers have (when it conflicts with certain ones they have) and the best that they can do is say “go back to DU” (and that’s to a FReeper, no less...) ... LOL...

I figure that everyone doesn’t buy into the birth certificate issue as being an issue that can get anything accomplished. I haven’t seen it accomplish too much, except of course, get a lot of people worked up over it. I was worked up over it before the election, too — but then the election happened and that was really depressing to see Obama get elected. I thought for sure that with Palin on board, we had a good chance at it. But, boy was I wrong. But, I’m still looking forward to voting for Palin in the future.

When I saw what a terrible thing had happened on election day and that no birth certificate was forthcoming, I immediately knew what the solution was — which was getting a few states to enact a law that requires a candidate to produce a birth certificate, or else he can’t be placed on the ballot in that state. And in fact, Oklahoma, Texas, Missouri and Arizona started that process in their states. Oklahoma failed this session and I’m going to work on it again next session.

BUT, in spite of that, some people who want the birth certificate have gone crazy and miss the “practical solution” of how to *definitely* get that birth certificate (i.e., that state law) and they even argue *against* that state law saying it’s a DU trick... LOL...

Anyway, just the other day, someone was saying that I was getting paid to post on this birth certificate issue and so I had to let them in on my GOP connections and set them straight on who I’m volunteering for (I wish the GOP would pay me, but they won’t...).

Here’s a post that I gave them... so just they would know what’s been going on with me... :-)


Ummm... it’s the GOP who have been talking to me about my posting, actually... :-)

They’ve said I’ve been doing a nice job, but they didn’t offer to pay, but said I could keep volunteering as long as I wanted to. But, the nice thing about it, is that they put you in touch with other GOP members, when you volunteer. I guess that’s a nice benefit.

I was just talking to Ann Coulter the other day, and she said to me, that this birth certificate issue is politically dead. She said, “Star, you know me and I don’t back off anything, but this thing is more like the Bildeburgers, than anything else, especially after the State of Hawaii said that he’s a natural-born citizen.” But she assured me that we’re going after Obama on his leftist policies — no let up there.

She said I should give a holler to Sarah, so I did. I told Sarah I was sorry about all the grief the press was giving her and I didn’t believe a thing that they said about her and Todd. So, I decided to ask her about what everyone wants to know. I asked, “So, are you going to do it in 2012?” Well, she said, “Look, Star, you know I can’t say anything about that one way or another, but let me ask you if you’ve noticed something.” I said, “Okay, what?!” She said, “Well, you know the ones who have been said to be Presidential possibles..., have you ever heard any of them talking about the birth certificate?” I said, “Ummm..., no, come to think about it.” Sarah then paused and said, “You can be sure that anyone who is talking about Obama’s birth certificate is not running for President!”... I said, “Oh, I’ve got it, you’re not talking about it so, that means....” She interrupted me right there and said, “Well, I was just speaking hypothetically, now.” I replied, “Okay..., gotcha, Sarah!”

She told me I should talk to Cheney more specifically about that, if I wanted to know about Obama’s birth certificate. Cheney was harder to catch up with, since he’s a busy guy, still defending Bush and his administration. When I finally did catch up, he said, “Hi, Star..., I hear you’ve been trying to get a hold of me. What can I do for you?” I explained about Sarah and the birth certificate and said I wanted to know about the Certification of the Electoral College vote in Congress. I asked why there were no objections from him in that Certification process, when he had the chance. He said, “Look Star, we don’t like Obama but we’re not crazy. We could look down on Obama through our satellites and see what he was reading every day, so there wasn’t anything we didn’t know about that liberal. Just because he doesn’t know who his daddy is, doesn’t make him not qualified for office. What were we going to do, make an objection and say, ‘You don’t kmow who your daddy is so you can’t be President?!’ That would never work and would have backfired on us in two seconds. There wasn’t much to do about it.”

I said, “Okay, I understand. I was just wondering...” He asked me how Steele was doing and we talked for a while then I got off. I had to get on down to Dallas, that evening.

While I was down there I decided to swing on by and see President Bush. I hadn’t been in his new house yet, in Dallas. They had to clear me through security and that took a bit, but I waited. Finally got in and the President showed me around. He is like they say, very nice and kind and a gentleman. I never get over being around him. But, this time I was on a mission and so I got down to it. I explained I had been talking to Dick and then asked, “What about Obama? Couldn’t y’all have done more for us?” He liked my Southern accent and said I was one of the good ole boys and I say, “Yessir, Mr. President, right here in Dallas, no less!”

He said, “Star, it’s like this. Can you imagine what those liberals would have done to us with this big depression coming on, and us winning the White House? They would have blamed us for all of it. Now, they’re trying to weasel out of it and we’re going to nail their hides to the wall this next election!” He got a chuckle out of his own explanation...” I asked him about perhaps doing something to keep Obama out of there and maybe Clinton in there instead and then there wouldn’t be all this trouble. He said, “We wanted the dumbest liberal we could find in office!”

“Oh..,” I said. “I see...”

I asked, “You’re not saying that you had anything to do with him being in there, are you.” And then, he looked at me and said, “Star, all I can tell you is that we don’t even know who his daddy is, so he’s not the only one...” and then he walked away laoughing loudly as he sauntered off to the pool with the rest of the guests. After that, I made my way out and visited the rest of my family in Dallas and then made my way back up to the Buckle of the Bible Belt, good ole Tulsa.

All I can tell you is that I sure do wish the GOP would pay me, instead of me just being a volunteer for them. But, it does have nice side benefits.


Well..., anyway..., I haven’t been volunteering to post here for the GOP all of the ten years that I’ve been around. And it’s been a nice time and I’ve enjoyed posting on various things that are important to conservatives, especially from the standpoint of the Bible and Christianity (which I think is essential to conservatives). So, after about 86 threads started and 23,300 posts done, I still love Free Republic and it’s the best place around and the only place that I ever want to post on (and I never post to any other forum).

Thanks a lot, Jim for your fine forum...

P.S. I like your posts about the Romney-ites, too... :-) and you know I’m absolutely serious about that, and was, right here on Free Republic even back at the turn of the century, with my posting (before Romney was even a candidate).

The "eligibility" issue now has a permanent place on the Congressional record, even if inadvertently.

As a follow-up... let’s say that I’ve been involved as far back as in the Reagan Administration, and remember meeting with Fawn Hall and Oliver North, and there was a time I was in Miami at the Hotel Intercontinental, on Key Biscayne, where the Contras and the Sandinistas used to come up and “talk”... :-)

I just can’t see trusting a newspaper with the responsibility of deciding who is eligible for POTUS. The birthers seem to have a somewhat plausible explanation for why the newspaper is irrelevant. Add to that the FACT that obama wont let anyone see his birth certificate and some other slightly questionable occurances and I think there is legitimate reason to be suspicious.

I’m with you on point number three. But when THE HELL is the SCOTUS going to make a ruling on this?? They’re dodging it and that pisses me off and makes me even more suspicious.
