Dr. Igel is still active in Pinellas Cty; seems is well regarded. I wondered if this went to trial because it seemed a weak case.

Could be Schiavo sued the doctor and the doctor was paid by HIS insurer, thus it would not appear in court records? And the doctor's insurer might be out of business?

I wonder if Fox made this comment before or after Michael Schiavo removed her wedding and engagement rings from Terri's hand and had them made into a ring for himself.

On Feb. 24, 1990, after a year of treatment, Michael Schiavo heard a thud in the bathroom. When he went to see what happened, he found his wife crumpled on the floor. She had suffered a heart attack, Fox said.

Let me get this straight now. On LKL he heard the thump and found her at the bottom of the stairs.

Didn't he also say in another interview that he heard the thump and found her in the hallway?

Gee, it's so difficult to keep up with the lies!

Well-this comment was printed in 1992-so it was probably just before....2,000,000 doesn't go very far when you promise to make someones life as good as possible with it and then decide, instead, to use it to fund attorneys willing to see that person murdered, legally.

He probably had the rings molded into a ring for Jodi. (Oh yikes---what if he didn't do that at all...but simply GAVE Jodi Terri's wedding ring? Wonder if the Schindler's ever looked at Jodi's finger when she was the prison guard, sent to watch them, as they visited Terri.

I believe you can go to Florida Office of Insurance Regulation and check lawsuits on doctors.
I'm a computer illiterate but one of you literates might try checking.

17 Section 1. (1) The Governor shall have the authority
18 to issue a one-time stay to prevent the withholding of
19 nutrition and hydration from a patient if, as of October 15,
20 2003:
21 (a) That patient has no written advance directive;
22 (b) The court has found that patient to be in a
23 persistent vegetative state;
24 (c) That patient has had nutrition and hydration
25 withheld; and
26 (d) A member of that patient's family has challenged
27 the withholding of nutrition and hydration.
28 (2) The Governor's authority to issue the stay expires
29 15 days after the effective date of this act, and the
30 expiration of that authority does not impact the validity or
31 the effect of any stay issued pursuant to this act. The

1 Governor may lift the stay authorized under this act at any
2 time. A person may not be held civilly liable and is not

7 the circuit court shall appoint a guardian ad litem for the
8 patient to make recommendations to the Governor and the court.

All I see here is that the GAL was to be appointed immediately after the stay was issued.

I didn't mean settle out of court.
I meant he went only so far in
defending himself, not so far as
to make MS the defendant, in a
sense. Expected to lose...cut his
losses...moved on. Coulda had some
reason for no OCS. Did a limited
defense. MS no prior abuse record.

Help - This has nothing to do with your remarks, as I need to know how to do something. How do you post without going into someone else's post? I'm not even sure my terminology is right. But, I've had to go into someone else's remarks in order to post my remarks. Also, are there instructions as how to get something copied in a post, like an e-mail, something from the net, another post, etc. And, how are italics, underscores, large/small fonts, etc. done? Thanks, SweetLiberty for your help. If anyone else wants to answer, too, that'd be great.

Without reading the trial transcripts, we're all just speculating. I would speculate that it was Schiavo's attorneys who demanded a jury trial. No way would the defense attorneys want the Schindlers, Michael and Terri to be in front of a jury. It's hard to imagine more sympathetic witnesses. The jury would see a very young, physically beautiful woman in a severely brain damaged state, possibly brought into the courtroom in a wheelchair. They would see a young, devoted husband who wants to become a nurse so he can bring Terri home and spend the rest of his life caring for her every need. At the time of the trial, I would guess that Terri's parents did everything within their power to make sure Terri got the maximum possible award for her rehabilitation and care. That would've included testifying about the loving, made-in-heaven marriage between Terri and Michael.

I'm not a lawyer, but I think the defendants would've been committing legal suicide to even suggest to a jury that the tragedy that befell Terri, her husband, and her devoted family had anything to do with spousal abuse.

I've read interviews with the Schindlers, their attorney, and Terri's friends all saying there is no proof she had an eating disorder. They seem to admit there's some possibility of that, but it isn't a certainty. The malpractice defendants had to have some legal theory about Terri's contributory negligence, or they would've been libel for up to $20 million. There had to be some reason given as to why this seemingly healthy and very young woman's heart suddenly stopped beating. Since Shiavo's attorneys sued on the basis of the undiagnosed potassium imbalance, that's what the defense had to prove they didn't cause. Terri had lost nearly 80 pounds since her marriage and was going to a gyno for diagnosis/treatment of missed menstrual periods, both possible symptoms of an eating disorder. Michael and the Schindlers were unable to testify that Terri did not have an eating disorder. This seems like the best winning argument the defendants could've proferred.

It would've been a very different case if Michael Schiavo had been the target of a criminal investigation. According to what we've read here and there, the ER staff where Terri was taken that night was suspicious enough to call law enforcement. The police questioned Terri's father about Michael, and Terri's father said there was no reason to suspect foul play. Under the circumstances, with a wife and daughter fighting for her life in an ICU, I think many law enforcement agencies would've just closed the book, quietly walked away, and given the family their privacy at such a painful time.

I'm a little too busy right now to get into detail at this time, but if you still have questions, drop me a note- either here or in an internal email- and I'll try to explain how I do these things. It's really pretty easy; you just need a few tips how to do it.
