Court orders free medical for illegals

BOISE, Idaho (Legal Newsline) - The Idaho Supreme Court on Monday ruled that an illegal immigrant who was injured is entitled to medical assistance.

In their ruling, the high court sided with Saint Alphonsus Regional Medical Center, which sued Ada County Commissioners after they denied an application for medical indigency assistance.

I agree with the court.

Sandoval, an illegal immigrant from Mexico, had medical bills of more than $187,000 after he had a stroke in 2006 while working near Boise.

Of course, the $187,000 should be backcharged to his employer, and the individual should be repatriated to his home country at the first possible moment.

His son, Francisco Pacheco Sandoval, applied for medical indigency assistance from Ada County while Sandoval was still hospitalized.

The Board initially denied the application because it concluded that Sandoval could not be a resident of Idaho as he was an illegal immigrant.

Overturning a ruling by Ada County Judge D. Duff McKee, the justices said immigration status does not affect whether someone is a resident of a county.

“Sandoval’s status as an undocumented alien does not affect the determination of whether he is a resident of Ada County,” Justice Roger Burdick wrote for the majority.

“The concept of residency does not distinguish between citizens and those who have entered this country illegally,” he added.

Concurring in the decision were Justices Joel Horton, Jim Jones and Justice Pro Tem J. Kidwell. Dissenting was Justice Warren Jones.””

EMTALA establishes pretty clearly that those who are hurt can get basic assistance. For the most part, courts and legislatures concur that denial of emergency care to anyone is pushing things too far.

The real battle is over “regular” care. Most tax payers would be shocked at what is paid out for illegals.

So according to the ruling if I could run and jump onto the bench with these judges that makes me a judge too since whether I am thee legally or not is not the issue.
Or say if I break into someone’e house I can take whatever I want because whether I am there legally or not is not the matter and I am entitled to whatever is in the house.
Looney lefty judges strike again.

This could help set a bad legal precedent, unless already set. The idea that there is no distinction, legally, between residency and citizenship could be applied in ways that we would not want to see. If we’re going to blur the distinction between simply residing somewhere, regardless of how you got there, and legal citizenship, then anyone here illegally will have the same legal status as American citizens. At least legally speaking, there would be no way to “discriminate”, at least as far as liberal judges are concerned.

The Left, through the agency of the Judiciary, and unfortunately, the “Right”, through the agency of RINOs and guilt-stricken, pandering, would-be conservatives, have found that the BEST way to make their points about how miserable our “Health Care System” is, is to flood the country with illegal immigrants who don’t have and will never need to have anything resembling insurance, have them inevitably get sick or injured, and thereby create an extra stress and weight on the system, the only solution for which is Nationalized, Socialized Health Care, “run” by the “Government” , i.e., subsidized directly by all us “millionaires” who have to spend 10 grand per year for our own Health Care. This is a SURE way to overstress a system everybody knows needs improvement. WhaT it doesn’t need is this viciously cynical “forcing of the issue” so that it collapses as it strives to take care of more and more people that can’t pay on their own.This is exactly the way our elected representatives have found to build their new constituencies, on our backs, and lead us into Socialized Medicine, one I.V. drip at a time.

He was not denied medical assistance. The case is over who should pay for it, in this case Ada County and their taxpayers. This type of situation is all to common along our Nation’s borders and has caused numerous closures of emergency medical facilites for lack of funding. That’s the price you pay for a lax policy regarding illegal aliens.

No, the statute says the program is available for residents. The court found that whether someone is an illegal alien does not affect his status as a resident, either you reside there or you don’t. I bet the state legislature could figure out a way to rewrite the law to exclude illegal aliens if the want to do that. Or would you rather the court change the law by changing the legal definition of “resident?”
