WASHINGTON -- A liberal legal scholar is withdrawing his nomination to an appeals court judgeship after Senate Republicans blocked a vote on his confirmation last week. Goodwin Liu, 40, said in a letter to President Barack Obama Wednesday that he and family need "to make plans for the future" now that there is little prospect of a Senate vote on his nomination.

Senate Democrats are going to be working over the Christmas break to deliver a lump of coal to the American people in the form of a radical changing of the Senate's rules. This is a naked power grab by liberals in the Senate pure and simple. The National Journal reports that Senate Democrats are laying the groundwork to chip away at the filibuster on January 5, 2011. They are going to push the idea that a simple majority of the Senate can abolish the filibuster rules, or radically change the rules, in a new Congress. I have sent the following letter via eamil and fax to my two Senators from Idaho, Seantor Crapo and Senator-elect Risch. I am also sending it to all of the other 48 US Senators. In my estimation, it is time we informed all of our representatives, from the President on down, who they really work for and what our expectations of them are. Regarding "Filibuster's traditional use is ignored" (Letters, Wednesday): The writer said the filibuster has never been used before to block a judicial nominee. The truth is that during the Clinton administration, 60 judicial nominees were blocked by Republicans, using means including the filibuster. In fact, Bill Frist even joined in the filibuster of 9th Circuit nominee Richard Paez. Also, Democrats have approved more than 200 of President Bush's judicial nominees while only 10 have been blocked. For Republicans to make such a big deal over those 10 nominations while they blocked 60 of Clinton's nominees is extremely misleading and hypocritical....

Apparently, a vote on the constitutional, or "nuclear," option could take place as early as this week. More simply put, a vote to end the filibuster could take place this week. As feministmajority.org explains the filibuster, "Right now, it takes only 41 votes to continue debate and block a vote on a judicial nominee. It takes 60 votes to end debate and force a full Senate vote." This use of the filibuster is obviously subversive. Those who use it, know it is subversive, and love it for that very fact. Those who oppose it, oppose it as a subversive tactic....
