This is for all the naysayers on Roberts and others who like to read the misleading headlines of the AP about Roberts and his confirmation hearing so far. First off, he never said he actually respected Roe v. Wade or that it deserves respect or anything directly about Roe. What he did do was talk generally about stare decisis and the ideas of precedent. He said that any case (including Roe) that has been decided by the Supreme COurt deserves respect in that it is a precedent of the court. Being in my first year of law school, we have...

Help! I`m A Hollywood Republican! Posted 8/18/2005 By Robert J. Avrech I am a Hollywood screenwriter. I have written feature films, episodic television, movies for network and cable. An Emmy Award for the screenplay for my film “The Devil’s Arithmetic” sits over the fireplace in our living room. I have won numerous awards and I have, thank God, made a good living in Hollywood. For an Orthodox boy from Brooklyn raised during the 60’s and 70’s, when all my classmates were bred to be doctors, dentists and accountants, I was obsessed — unnaturally so — with the movies. For a...

IT says "Newsweeklies slips at the Newstnad" on both the main page of yahoo in the "In the News Section" and then when you click on the link, it is also the title of the article
  • A few things of interest on Roberts and abortion

Bench Memos ALL EYES ON THE COURTS Roberts’s White House Counsel Records--Abortion [Edward Whelan 08/15 05:13 PM] Two items are noteworthy (in addition to Roberts’s unequivocal condemnation of bombings and other acts of violence against abortion clinics): 1. In October 1985 Roberts was asked to review a proposed telegram to be sent to a memorial service to be held in Los Angeles for some 16,500 aborted fetuses that had been discovered at a medical laboratory in 1982. The draft telegram, quoting Lincoln’s words at Gettysburg, stated that “just as the terrible toll of Gettysburg can be traced to a tragic...

Can someone please calm my nerves. All this talk about who Bush might appoint is worrying me. I don't care if a liberal judge, moderate judge, or conservative judge retires, Bush has promised he will appoint originalists to the court. The idea is not to keep the status quo and replace a moderate judge with a moderate. The whole point of working to reeelect Bush was to get him to replace conservatives with conservatives, moderates with conservatives, and liberals with conservatives. I think for the most part, Bush, Rove, Mehlman know they must do this as not to piss off...
  • Questions about Constitutional Option

Two questions about the potential use of the constitutional option: 1) If the Democrats were to continue filibustering Bolton, would Frist consider using the constitutional option and make it apply to all executive branch nominations (originally it was only going to be for judges)? 2) Within the constitutional option, does it at all deal with what would happen to nominees that got bottled up in committee, say because there was a Democrat president and Republican Senate. I believe that every nominee is mandated a Senate Floor vote and that not only are filibusters unconstitutional, but any procedural techniques to deny...

Who currently on the Supreme Court can we be somewhat confident would vote to overturn Roe. V. Wade and how many more do we then need for Bush to appoint to have the 5 to do so? (include Renquist as yes vote as we can assume when he retires his whoever takes over for him will be pro-life. I got three definites: Scalia Thomas Renquist (or replacement) Is there anyone else of the remaining six justices. If not, then I guess we need 3 more originalists on the appointed to the Supreme Court.

Anyone know if the constitutional option will apply for all presidential nominees or just judicial nominees? With the Dem's looking to maybe filibuster Bolton too, I think Frist should declare any filibuster on a presidential nominee as against the rules if he isn't going to already. After all, the clause in the constitution that we we refer to to back up our claim that filibustering judicial nominees is unconstiutioonal doesn't just talk about judicial nominees, but any presidential nominee!!!

Sorry for the vanity, but this whole entire filibuster of presidential nominees gets me so angry. There is a simple message in all of this garbage going on. Every person that Bush nominates for any court, department, agency, etc., is mandated by the constitution to get an up or down vote on the senate floor. This is the case even if the nominees do not make it through commitiee. Committe hearings on nominees are constitutional to get information on them, but unlike legislation, they cannot at the end prevent the Senate from voting up or down on the nominee!!! This...
  • Aren't filibusters of any presidential appointments unconstitutional???

From what I am aware, isn't the filubustering of any presidential appointment unconstitutional? If Frist does go nuclear (or constitutioal as we like to say), shouldn't he do so for all presidential appointments? While I hate the filubuster period, the Senate has the authority under the constitution to use it on legislation. However, if you are going to argue it is unconstitutional for judges, than it also is for any appointment because you are using this clause in the constitution: Article II, Section 2 declares that the president "shall nominate, and by and with the advice and consent of the...

Happy Easter to all from a close Jewish friend! My mom is Christan, but my dad is Jewish. He had the last say to bring us up Jewish, but we celebrate Christmas and and Easter. Point being, mny family is a perfect examples of the closeness between Jews and Christians. We are all of the same line and may we grow closer during these troubled times. May G-D bless you all and once again have a Happy Easter!

The Terror Tactics of the ACLU By: Bill O'Reilly for BillOReilly.com Thursday, Mar 03, 2005 It would be hard to imagine a better friend to Al Qaeda and other terrorist outfits than the American Civil Liberties Union. If that statement shocks you, please allow me to back it up with facts. A few days ago, the ACLU announced it will sue Defense Secretary Donald Rumsfeld on behalf of eight foreign nationals who say they were abused by American forces in Iraq and Afghanistan. The ACLU contends that the ultimate responsibility for the physical and psychological injuries sustained by the men...

Any freepers have updates on the following immigration issues: 1) Any luck with the House or Senate reorganizing the budget to include more than 210 new border agents. I know Sensenbrenner said they would try to do so. 2) What's the update of the Read ID act. Will it be a add on to the Iraq and Afghanistan emergency funding and what is the chance of the Senate passing it as such?

If anyone is interested, O'Reilly just did a segment and is doing another one attacking the MSM for sympathizing for that lunatic saudi (even though he was palnning to assasinate Bush; usual culprits supporting him; the Washington Post and New York Times), but not giving the benfit to the Marine who shot the Iraqi in the mosque in Fallujah. Does it surprise anyone that the MSM is supporting terrorists over our own soldiers?

The New Dean On Campus By: Bill O'Reilly for BillOReilly.com Thursday, Feb 10, 2005 Twice I have underestimated Howard Dean. I never thought he'd be competitive in the democratic primaries and, not learning my lesson, I foolishly predicted he would never get the top job at the Democratic National Committee. So I won't blame you if you stop reading my latest thoughts about Dean. The Governor is a driven man who brings a sense of certainty to a party in trouble. The Democrats are waffling around all over the place. The left-wing of the party got battered by the successful...

To the honorable Congressman F. James Sensenbrenner, Jr.: As you know, President Bush has only allocated for an increase of 210 border agents in the budget he recently sent to Congress, even though the immigration act signed earlier in the year calls for a 2000 a year increase over a 5 year period. From what I am aware, Congress can fudge around with the budget accordingly. Are you going to try to increase the number of new agents funded by Congress over what Bush allocated and is there anyone else we can contact to make this number increase to what...

I just was flipping through the channels and came across room raiders on MTV. I watch it sometimes and it can be entertaining. However, tonight I was uterly disgusted to see an actual gay segment of the program. There were three gay guys who had their rooms raided by another guy. Listen, I am not homophobic. I have no problem with gay people if they keep what they to the privacy of their home. I do have a problem with those gays that try to redefine marriage or in this case push their lifestyle in the public sphere. MTV is...
