Huckabee: Don't Punish Children of Illegal Immigrants (RINO ALERT) (Huckster for DREAM Act?)

Former GOP presidential contender and potential 2012 candidate Mike Huckabee said Wednesday that he does not support a repeal of the 14th Amendment -- a part of the Constitution other Republican leaders have called into question recently because it guarantees citizenship for children born in the United States, regardless of their parents' immigration status.

Huckabee said in an interview Wednesday that he does not support a repeal, NPR reports.

While the former Arkansas governor said, "I'm not for an amnesty program," he added, "You do not punish a child for something the parent did."

Huckabee told NPR that the nation is better off giving all children opportunities to succeed as citizens, even if they were not born in the United States.

"The question is: Is [an undocumented child born outside of the U.S.] better off going to college and becoming a neurosurgeon or a banker or whatever he might become, and becoming a taxpayer, and in the process having to apply for and achieve citizenship, or should we make him pick tomatoes?" Huckabee said. "I think it's better if he goes to college and becomes a citizen."

It doesn't matter what he said. What matters is what the ammendment says. Perhaps he screwed up. Perhaps he didn't understand the terms. It still says what it says.

"The fact that the court got it wrong over a hundred years ago doesn’t change why the amendment was written or how it has been twisted into something entirely different."

But the court didn't get it wrong. It was correct. The meaning of the term long predates that court, the ammendment, or even the country.

You do realize that by putting illegal aliens outside the jurisdiction of the United States, you are granting them immunity from our laws, just like an ambassador, right? Because that's exactly what "jurisdiction" means.

That is obviously not the case now, but that's exactly what these people are arguing for without realizing it.

Senator Jacob Howard, the author of the citizenship clause in the Fourteenth Amendment, defined who would fall within the "jurisdiction of the United States":

"[E]very person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons."

The interpretation offered by this Political Science professor depends on misreading the quote. Howard isn't defining multiple classes, he's defining one. He's defining which "aliens" and "foreigners" he means when he says "who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States".

That understanding it totally in keeping with the modern understanding of "under the jurisdiction", and with the understanding that predates the 14th, and the country.

I guess you misunderstood my second sentence nmh. that WTF? was not for you, but other people in general that think differently than you and I, that those kids should stay. I was 100% in agreement with everything you said in your original post, I guess I just worded my response a bit badly, giving the wrong impression to you. that ‘WTF’ was for millions of Americans that I’m afraid have just not yet seen what will happen down the road if these kids are allowed to stay and fester. sad isn’t it? and even here on FR there are those who feel those kids should stay!

This statement makes no logical sense. Should we also not punish the children of people who DO NOT cross the border illegally and make them citizens as well? Basically he is saying not to have American citizenship is punishment....
